Section 26: what a tour advert has to tell people

Section 26 of the Tourism Business and Guide Act B.E. 2551 (2008) (opens in a new tab) says that when you advertise or offer a tour programme, you have to give at least nine details. Below is a tour page with all nine on it, numbered in the order the law lists them.

If the trip changes from what you advertised, Section 27 says you tell the traveller before you take their money. Section 83 sets a fine of 5,000 to 50,000 baht for an operator who doesn’t follow Section 26 or 27.

So every tour page we build uses the same layout, with a place for all nine, and we fill it in from your programme. The Act doesn’t say outright whether a web page counts as an advert, but travellers look for these details before they book anyway. This section summarises the Act; it isn’t legal advice.

Do you run your own trips, or resell someone else’s?

Most tour companies in Thailand are one of two kinds, and each needs a different website.

You run your own trips

Your own boats, vans or guides, and trips nobody else sells in quite the same way. Each trip can have a page that ranks on its own, like a Phi Phi tour from Phuket or a cooking class in Chiang Mai. This is the kind of business our sites are built for.

You resell wholesalers’ series tours

Japan or Korea tours with many departure dates, where prices and seats change daily and the same programme sits on hundreds of other agents’ sites. A platform that pulls programmes in from the wholesalers automatically suits you better, and costs less than a custom build. We’ll say so before taking the job.

You do both

Keep the wholesaler platform for the series tours, and let us build pages for the trips you run yourself, with a link across to the platform from your site.

Rajadamnern–Lumpinee uses the second: booking stays on GlobalTix, as the client wanted, with a button to it on every page of the new site. For the third, we quote after a chat.

The request form asks only for what you need: a name, a way to reach the guest, the date, the group size and the pickup hotel, with a link to your PDPA privacy notice. It doesn’t ask for passport numbers; if a trip needs them, you ask in the chat once the booking is confirmed.

What a direct booking is worth

Klook, GetYourGuide and Viator do bring in new guests, but they take a commission on every booking. None of them publishes a fixed rate, and your real one is in your contract. A supplier guide updated in August 2026 (opens in a new tab) puts Viator and GetYourGuide at about 20 to 30 percent and Klook at about 15 to 25.

We don’t suggest leaving the platforms. Plenty of travellers find you there first, then search your company name on Google before they book. Your own site is where those people can book with you directly, and where past guests come back to book again.

Tour website questions

I don’t have my tour licence yet. Can we build the site now?

Yes. We can build while you wait and launch with the licence number once it arrives. Section 15 says anyone who wants to run a tour business applies for a licence first, and Section 80 sets up to two years in prison or a fine of up to 500,000 baht for running one without it.

Where should the licence number go?

In the footer of every page and in the details box on every tour page, next to your company name and address, which is the first item Section 26 lists.

My itineraries are PDFs. Can we just upload them?

They’re a good starting point. We write the details from the PDF onto the tour page as text, because Google and people on phones read a page far more easily than a PDF, and keep the file as a download too.

We already sell on Klook and GetYourGuide. Do we still need our own site?

Keep selling there. Your site is for people who search your company name, people who want to ask something before booking, and past guests coming back. Those bookings carry no commission.

Prices change with the season. Can we update them ourselves?

Yes. Prices, dates and details on every tour page can be edited from the back end. If you’d rather not, the Care Plan includes up to 5 content edits a month. For a tour someone has already booked, Section 27 says a change is told to the guest before you take payment.

Can guests pay a deposit or the full price on the site?

The request form takes no payment; you send payment details in the chat once you confirm. Taking card or PromptPay payments on the site itself is Custom work, quoted after a chat. On refunds, Section 28 sets a minimum, announced by the Board, when a trip is cancelled through no fault of yours, and a full refund when it doesn’t run because too few people booked or the fault was yours.

Will foreign travellers find the English pages?

We write the English pages around what visitors search, like phi phi day trip from phuket, rather than translating the Thai word for word, and set hreflang so Google shows each searcher the right language.
